REGULAR MEETING

APRIL 12, 2022

MINUTES

 

Mayor Blakley brought the First Regular Meeting of the Dinosaur Town Council to order at 6:00 p.m.  Those present were Mayor Richard A. Blakley, Trustees Darcie Rocque, Devonna Wilczek, David Heinrich, Charles Winkler, Robert Essex and LeRoy Trujillo.

 

Mayor Blakley said that he wanted to make an amendment to the agenda.  He said that they needed to appoint representatives to the County Health Pool, for health care.  Trustee Heinrich made a motion, seconded by Trustee Winkler to add the Designation of Representative to County Health Pool to the agenda.  Ayes: 7. Nays: 0. Motion carried.

 

Trustee Heinrich made a motion, seconded by Trustee Winkler to accept the expenditures as presented.  Ayes: 7. Nays: 0. Motion carried.

 

Trustee Winkler made a motion, seconded by Trustee Heinrich to accept the minutes from March 8, March 22 and April 4, 2022 as presented.  Ayes: 7. Nays: 0. Motion carried.

 

Mr. Steve LaBonde said that they are wanting to finalize Taylor Excavating Contract with the manhole project.  He said that they decided to finalize the project so that they could release the retainage.  He said that they need to do a change order for an increase in the contract of $5128.80.  He said that the original contract was for $57,700, so it will bring it to $62,828.80. Trustee Heinrich made a motion, seconded by Trustee Wilczek to accept the reconciliation of $5128.80.  Ayes: 7. Nays: 0. Motion carried.

 

Mr. LaBonde said that Taylor Excavating pay estimate number 2 is for $3141.44, which is 5% retainer until they get the tax issued resolved.  He said that they will have to advertise in the Rio Blanco Herald Times. Trustee Heinrich made a motion, seconded by Trustee Winkler to accept pay estimate #2 for $3141.44.  Ayes: 7. Nays: 0. Motion carried.

 

Mr. LaBonde said that the town could not do the final pay estimate until the town advertises in the paper.  It will be published April 14th and 21st, and can be paid ten days after the publication, which would be May 2nd.  He said that they would have to do a Resolution to accept the project.  Resolution 22-2.  A Resolution to accept final completion of the Town of Dinosaur’s Sewer collection system manhole replacement project, and to release all final payments to the Contractor for said project was read.  Trustee Heinrich made a motion, seconded by Trustee Winkler to accept the Resolution as read.  Ayes: 7. Nays: 0. Motion carried.

 

Mr. LaBonde said that they are waiting for the lagoons to thaw so that Anson’s can come back to replace the valve.  He mentioned that they are holding $6000 on them.  He said that the flow meter is running pretty consistent.   He said that he hopes to get this contract closed out, so that we can try and withdraw the Town from the Colorado Discharge Permit.   Mayor Blakley said that the fees are $1400+.

Mr. LaBonde said the now they need to line the pipes.  He said that they will need to start looking at costs for this.  He said that we need to get Taylors Contract closed out before we move forward. 

 

Mr. Tex Bird was not present.

 

Mayor Blakley said that they need to designate representatives to the County Health Pool.   Whereas, the governing boy of Town of Dinosaur (“Public Entity”) is advised that the business to be conducted at Members’ Meetings of the County Health Pool must be transacted by the Official Representative of each Member; NOW THEREFORE, BE IT RESOLVED, that the governing body of Town of Dinosaur (“Public Entity”). Here and herewith: designates the following individual as its Official Representative to all County Health Pool Members’ meetings.  And PUBLIC ENTITY DESIGNATED CORRESPONDENT (individuals(s) that will receive monthly billing invoices, provide enrollment terms/add/changes and other general correspondences intended for distribution to employees) was read.  Trustee Heinrich made a motion, seconded by Trustee Rocque to designate Laurance Elarton as Representative and Tamara Long as Alternate Representative for the County Health Pool.  Ayes: 7. Nays: 0. Motion carried.

 

Mayor Blakey said that after talking to the Town Attorney Mr. Ed Sands today we will need to set a date for the drawing of the marijuana license.   He said that they need to set up for a lottery draw.  Trustee Essex made a motion, seconded by Trustee Rocque to set the marijuana draw for Thursday April 14, 2022 at 6:00 p.m.  Ayes: 7. Nays: 0. Motion carried.

 

Mayor Blakley said that he has a grant presentation with AGNC for the flowers on April 15 at 9:30.

Trustee Wilczek asked if they put in with the LMD for a grant.  Mr. Jim Evans said that they did for pole banners, signs for the entrance of town and 60 sets of flowers.   He said that the Fire Department will water the flowers. 

 

Mr. Elarton said that he wanted to thank Devonna, David and Chuck for their service on the Council.  He said that they worked hard and showed up to help this community.  He said that it is very appreciated.

Oath of office for the new Council Members.  New Council sworn in are Richard A. Blakey, Mayor, Trustees Marshelle D. Gray, Michael R. Taylor, LeRoy Trujillo and Jeremiah Gray.

 

Mayor Blakey said that they would have to appoint a Mayor Pro Tem.  Trustee Essex made a motion, seconded by Trustee Trujillo to appoint Trustee Darcie Rocque as Mayor Pro Tem.  Ayes: 7. Nays: 0. Motion carried.

 

Mayor Blakley said that they need to appoint town officers, which in Town Administer, Town Clerk, Town Lawyer, Town Judge and Finance. 

Mr. Elarton said that the Council reappoints us in our positions if they want to.  He mentioned that the Town Administrator oversee the codes, getting projects done and making sure the budget is correct.   He said that if they do not have an Administrator, it is the mayor’s responsibility. 

He said that Tamara is the Town Clerk and she has been doing finance right now.  Her rule is to keep meetings legal, election and municipal clerk. 

The Town Lawyer Edward Sands has been here for about 30 years so he knows Dinosaur and that is a plus.

 He said that Municipal Judge is Matthew Bradley he was the youngest Judge to be appointed by two days.  He is also a District Court Judge on the Western Slope. 

He mentioned that Jim has been our IT person, and he knows Finance and has been in Finance.  He said that there is an issue with the state on and IT budgeting issue which he has been working on, he also knows grants.  He mentioned that they hired a grant writer to help with the grants and other people on the grants that did not know the accounting process.  He said that we need to fix this and go back to finance like they had in the past.  He said that the expansion was included in the budget.   

Trustee J. Gray asked if the finance would be split between Larry, Tamara and Jim.  Mr. Elarton said that he will oversee the finance.  He said that Tamara will be responsible to accept the money.  Jim will be responsible in balancing the budget. 

Trustee M. Gray asked if there is a long-term software payment.  Mr. Elarton said that there is a yearly subscription for the software that the offices use.  It pays for all update.  He said that he has working with Caselle since he was in Rangely.

Trustee M. Gray asked if this is the point that they recognize them for the accomplishments or just roll them into it.  Mr. Elarton said that they are welcome to do it at the first council meeting.  He said that the employees that are appoint work for the Council.  And the town employees work under the Town Manager.  Trustee Essex said that if there are questions about an employee, they need to talk to the Town Manager.  

Trustee Taylor asked if they should get this cleared out or wait for the rules on who is doing what.  He said that it sounds like in a transition on who is doing what.  Mr. Elarton said that he believes we can work out everything on our end.  He said right now they are getting up to speed on things.   He said that he thinks everyone here is doing the best job that they can.  Trustee Essex made a motion, seconded by Trustee Trujillo to appoint the administration.  Ayes: 7. Nays: 0. Motion carried.

 

Mr. Elarton gave the new council members an update on what was going on with the marijuana licensing. He said that by ordinance there should be four licenses that were available for the retail stores.  He said that we issued three licenses but someone had contested for the fourth license.  He said so we had to reopen the applications for the fourth license.  He said that we ended up with three applications.  So, we will have to do a lottery for that license.  Mr. Elarton said that we have licenses open, for four medical, testing, and manufacturing, and three more for grows.  They will be open until applications are full.

 

Trustee Essex made a motion to adjourn the meeting at 7:15 p.m. all were in favor.
